iii. How We Conduct Engagements

The Manner of Practice

Written Fee Disclosure

Fees are disclosed in writing before instruction is confirmed. Advocacy fees are quoted separately from written-work fees. No fee is revised upward without prior notice and agreement.

Merits Assessment Before Instruction

The firm forms a view on the merits before accepting instruction. Matters considered unlikely to advance properly are not taken on. This is stated to the prospective client plainly.

Substantive Written Advice

All material advice is provided in writing. This gives the client a permanent record and allows the reasoning to be examined at leisure rather than only at the time of conference.

Court Appearances in Johor

The firm appears regularly before the Johor Bahru High Court. Where the matter proceeds to the Court of Appeal in Putrajaya, the firm continues to conduct it directly.

Conflict-Check Before Engagement

A conflict-check is conducted before any confidential information is exchanged. Prospective clients are informed of any conflict promptly, and referred elsewhere where appropriate.

Realistic Timeline Disclosure

Clients receive a written estimate of the procedural timeline at the outset of each engagement, updated as proceedings develop. Realistic expectations are considered part of proper instruction.

iv. Engagement

Does your matter warrant instruction?

Send a brief outline of the matter. The firm will review it and advise whether it falls within the practice areas, and on what terms instruction can be considered. There is no obligation at this stage.

v. Frequently Asked Questions

Questions About Instruction

How does the firm decide whether to accept instruction?
The firm reviews the outline of the matter submitted at enquiry stage and forms a preliminary view on whether the case presents arguable grounds and falls within the areas in which the firm practises. Matters where the firm cannot see a reasonable path to advancement are not accepted, and this is communicated to the enquiring party without delay.
What information should I provide at the enquiry stage?
A brief factual outline of the matter, the identities of the parties involved (for conflict-check purposes), and the nature of the relief or outcome you are seeking. Detailed documents need not be provided at this stage. The firm will advise what further materials are needed once the preliminary review is complete.
How are fees structured?
Fees for written work (drafting, advisory opinions, letters before action) are quoted at the outset based on the scope of work. For litigation matters, written-work fees and advocacy fees are quoted separately. The fee quoted for written work is held to; advocacy fees may vary if the scope of hearings changes, and any revision is notified in writing before it is incurred.
How long does civil litigation typically take?
Timeline depends substantially on the complexity of the matter, whether parties take interlocutory steps, and the court's scheduling. The firm will give a written estimate of the likely procedural sequence at the outset of each engagement. For contested matters before the Johor Bahru High Court, a timeline of twelve to thirty-six months from filing to judgment is common, though this varies considerably.
Can the firm assist with matters outside Johor?
The firm's litigation practice is principally before the Johor Bahru High Court and the Court of Appeal in Putrajaya. Commercial drafting and letter-before-action engagements are not geographically restricted and may be conducted for parties based elsewhere in Malaysia, as the relevant agreements are governed by Malaysian law in any case.
What is the letter-before-action conference?
It is a fixed-scope engagement in which the firm reviews the materials underlying a contemplated demand, drafts a substantive letter before action addressed to the counterparty, and provides written advice on the likely procedural options that will follow. It is suited to disputes at an early stage where a measured approach may prompt resolution before formal proceedings become necessary.
